Terms of Use and Privacy Policy

The SED App (hereinafter referred to as the Application) is developed and maintained by Loeffa Soluções Tecnológicas LTDA – ME, CNPJ 23.432.836/0001-60 (hereinafter referred to as Loeffa), a Brazilian company, which provides access to this application for free , with paid functionalities (“Freemium” application). The Application is a tool designed to assist in individual and/or family health care, allowing data to be registered by the Application User (hereinafter referred to as User) and subsequent access to this data. The Application is governed by this Term of Use and Privacy Policy, which were designed to ensure the confidentiality and security of data entered by the User in the Application. The User agrees to this document when using the Application or associated systems in any way. If the User does not agree with these Conditions of Use, he must not use the Application or the services associated with it. The use of any functionality of Saúde em Dia implies full acceptance of these terms. These Terms of Use and Privacy Policies may be updated or changed by Loeffa at any time. Any changes will be notified to the User through the application and / or by email. After the changes are posted, continued use of the Application constitutes User’s agreement to the new terms.

TERMS OF USE

A. About Application Access

  1. In order to use the Application, the User must have and operate the software and hardware necessary for such use. The User is responsible for purchasing, installing and maintaining any and all software necessary to access the Application.
  2. The Application is available exclusively on Google Play. The use of the Application from any other source is not recommended by Loeffa and the User assumes the risks if using the Application from any other source.
  3. Login to the Application is optional. However, access to some features, such as data backup and profile sharing, is subject to the user’s login to the Application.
  4. Login to the Application is done using your Google account or your Facebook account, which have their own Terms of Use and Privacy Policies.
  5. Some features of the application, such as login, backup, profile sharing, among others, will only be available if there is an active connection to the Internet, which is the responsibility of the User, as well as the costs of using the Internet.
  6. The Application has 1 (one) free profile. Additional profiles can be purchased through subscription, made available by Google Play.

B. About Application Usage

  1. The User agrees to:
    1. DO NOT use the Application or any content or services related to it for any unlawful purpose;
    2. DO NOT upload files or other data, do not make data or any other materials not belonging to the User available through the Application, as well as viruses, bugs, corrupted data or any other harmful item;
    3. DO NOT interfere with the operation of the Application and systems associated with it, as well as DO NOT abuse the resources of the Application in an abusive or disproportionate manner;
    4. DO NOT use the App to distribute, share, disseminate or record any information, material, illegal, indecent, obscene, transgressive, defamatory, vexing, inappropriate, discriminatory, exploiting or deceiving, hate speech or violence.
    5. Use the application in accordance with all local, state, national and international laws, rules and regulations
  2. The data entered in the Application are the sole responsibility of the User.
  3. By using the Application the User declares that all data and information provided are true, is responsible for any and all documents, data or information inserted and any consequences that may cause, such as, but not limited to, errors in treatments and misunderstandings between doctor and patients.
  4. The profile sharing service is optional and takes place via a sharing link. The way in which the User transmits this link to other Users is the User’s choice and responsibility, Loeffa being exempt from responsibility for the consequences of any misuse of this link by the User who shared it or the Users who received this link, as well as any link transmission error through third-party applications.
  5. The User is aware and agrees that any data changes, such as editing or deletion made in the Application, are irreversible. In the case of shared profiles, changes are also shared, irreversibly.
  6. Loeffa reserves the right to suspend or block access to the Application and remove any data that it considers to be a violation of any of these conditions, without prior notice, as well as to make said information available when requested by court order.
  7. The User is solely responsible for any damages that it may cause, as well as its repairs and repair costs, to the Application, to the systems associated with the Application, to other users, or to third parties, when through the Application or its associated systems, and should bear any and all losses, of any nature, that may be caused.
  8. The User is responsible for registering their medicines and using them, so that the Application is only an auxiliary mechanism, therefore, the User agrees that there is no responsibility of Loeffa regarding the inappropriate use of medicines.

C. Links to Other Sites

  1. The App or the App’s website may contain links to other websites. These websites are beyond Loeffa’s control, and access to and / or permanence on these websites will be at the user’s own risk.
  2. All copyrights and trademarks accessible through the links provided in the Application or on its website are the property of the respective owners of the websites or their licensors.

D. About Application Operation and Security

  1. Loeffa built the Application based on current security requirements to protect the User’s data, however the User agrees that he is responsible for the security of the data on his device, being the User’s obligation to keep his device up-to-date and safe, relieving Loeffa of responsibilities about the action of malicious software on the User’s device or on the Internet network that he used to connect to Loeffa’s servers.
  2. Despite the compatibility of the Application with most devices, for technical reasons, Loeffa does not guarantee the correct functioning of alarms and other functionalities of the Application, since they depend on hardware and software developed by third parties.
  3. The Application has a purely auxiliary function, since the operation of the Application is linked to electronic systems susceptible to failures, the User should not rely solely on the Application to carry out his treatment, including his system of alarms for medicines and reminders for consultations and tests, and the User assumes full responsibility for the treatment, as well as compliance with medical guidelines, exempting Loeffa from any responsibility for the consequences of poorly done or unsuccessful treatment.

E. About Intellectual Property

  1. Loeffa owns the Application, the Saúde em Dia brand and the logical flows implemented in the Application and associated systems.

F. About Support

  1. Any doubts regarding the information contained herein, or about the Application itself or any nonconformity in the functioning of the Application, can be sent through the email contato@loeffa.com or through the “Feedback” menu available in the Application.

G. About Profile Backup, Syncronization and Sharing

  1. The Backup, Synchronization and Profile sharing services are subject to the availability of an active connection to the Internet and between the device where the Application is installed and the Loeffa Servers. Without this connection, these services will not occur. Connections between the Application and Loeffa Servers may be subject to local and / or international policies and maintained by third parties.
  2. The Backup service takes place automatically after the User has logged into the Application. Backup does not occur without login.
  3. The Backup service occurs by sending, in an automated way, the User data to Loeffa Servers.
  4. The Synchronization service occurs automatically when the User logs in with the same account on the Application on more than one device. This service is subject to the availability of an active Internet; connection as per item G.1 for all devices in question. Editions of any kind on any of the devices in question will be disseminated to the other devices.
  5. The Profile sharing service requires the User to click the Share button (). To use this service, the user must be logged in. Clicking on this button will generate a share link. This link is valid for 24 hours and can only be used once. The User must send this link to another User whose user wanted to share the profile. By generating the sharing link, the User assumes full responsibility for the correct handling of this link and its security, and must pass this link on only to other Users in their strict and absolute trust and through secure means. By passing this link on, the User grants Loeffa the permission to give full and unrestricted access to the User with the link, who can edit the data, insert new data, delete the existing data and share the profile in question with other Users.
  6. The profile sharing will only occur after the sharing user clicks the sharing link and its consequent use by the Application installed on the receiving user’s device.
  7. If the User who receives the share link does not have profiles available, as per Item A.6, he will only have access to the profile in read mode. That is, you will not be able to edit, add new information or share the profile in question.
  8. Profile sharing can only be revoked by deleting (Deleting) the profile in question by the User receiving the link.

H. About the Availability of the Application and Associated Services

  1. Loeffa reserves the right to modify, suspend or terminate the availability of the Application and the services associated with it, without prior notice. In case the User has acquired Slots subscriptions, according to Item A.6, the subscription will be canceled and Loeffa will make the service available until the subscription expiration date

PRIVACY POLICIES

I. Information Collection

  1. Through our websites and apps Saúde em Dia, information is collected in the following ways:
    1. Information provided by you in the app – When you log in to the app, Personal information (such as name, age, weight, medicines, …) provided when filling out forms and files inserted as attachments are sent securely, via HTTPS, to our servers . Payment details are entered directly into the Google Play tool, according to your own privacy policy and terms of use. No payment details are transmitted or stored on Loeffa’s servers.
    2. Information provided by your login service (Google or Facebook) – When you log in to the app, we collect your email to validate your identification. We also collect your profile picture from the respective login service (Google or Facebook), which is public, as a way to facilitate the creation of the first health profile in the application. If you don’t want to use it, just delete the first profile picture. If you share your health profile with other users, they will also have access to this profile picture.
    3. Application usage information – When you use the application, we collect data regarding the device (such as name, identification, manufacturer, model and operating system), usage and navigation data (such as access number for each feature) and error reports . We use Crashlytics and Answers to collect errors and usage information.
    4. Website navigation information – When you visit our website, a cookie is inserted in your browser through the Google Analytics service, to identify how many times you return to our address. Access information such as IP address, geographic location, source of reference, type of browser, duration of visit, clicked links and pages accessed are collected anonymously.

J. Use of Information

  1. Personal information provided through the application will be sent to Saúde em Dia’s servers, with the purpose of enabling data backup for the user and the sharing of profiles between users. The data can be recovered by logging back into Saúde em Dia, on the same or another device. Profile sharing is subject to the sending of a sharing link, referring to a profile, from one user to another. The share link gives full access to the shared profile.
  2. Usage and navigation information, both on the website and the application, may be disclosed as research and statistics, with no personal information being revealed openly.
  3. Loeffa may make use of the data, such as, but not limited to, location, medications, diseases, symptoms, measurements, allergies, consultations and tests, to carry out statistical studies, maintaining the anonymity of the User. Loeffa will be able to share the results of the studies with its partners, as well as use the results in publications.

K. Access to Information

  1. They will be able to see your personal information only who has access to your device in which the information was inserted and who has the profile sharing link, according to Items G.5 to G.8. So share profiles only with people you trust. No personal information may be released to the public without your prior authorization.

L. Deletion to Information

  1. Users may request data deletion by sending a message through the contact form on this website, informing the email address registered in the system and expressing the desire to delete their data. Loeffa will contact you via the email provided, asking for confirmation of the deletion. Once the confirmation has been received, Loeffa will delete the data referring to the confirmed email from the Saúde em Dia servers.
  2. Loeffa reserves the right to delete accounts that fall into disuse, that is, that remain for a long time without access by the User. This deletion will only occur after notification by email, and after a window of at least one week, which is sufficient time for the User to enter the system and reactivate his account, if interested.

FINAL DISPOSITIONS

M. Legislation and Forum

  1. These Terms of Use and Privacy Policies will be governed, interpreted and executed in accordance with the laws of the Federative Republic of Brazil, regardless of the conflicts of these laws with laws of other states or countries, with the Jurisdiction of the District of Florianópolis, Santa Catarina, being competent. Brazil, to resolve any doubts or litigation arising from this instrument.
